seen employee not wash hands after using bathroom and go back to kitchen

i went to the resturant on 3/9/2012 at about 545pm and observed an hispanic male go to the bathroom and not wash his hands and go into the kitchen, and i told my waitress and she said let her check and came back and told me "its ok hes washing dishes" so i was shocked,,she seemed like it was ok to do that, i thought all employees that worked in the kitchen were to wash their hands, dont know if it had anything to do with that employee or not but i threw up later on and my wife said her stomach bothered her. food was not that great, that was our first and last time to this place.they had a 94% food grade.
